General terms and conditions for the rental of a means of transport

General provisions

These General Terms and Conditions of Vehicle Rental (hereinafter referred to as "GTC") regulate the rights and obligations of the lessor of the means of transport (hereinafter referred to as "Lessor") and the lessee of the means of transport (hereinafter referred to as "Lessee") arising from the contract of lease of the means of transport.

For the purposes of the contract, the lessee shall be understood as a natural or legal person who has made a reservation of the vehicle, received a confirmation of the reservation from the Lessor (e.g. in the form of an advance invoice), paid this invoice or personally visited the Lessor's branch, accepted the terms of the lease and took delivery of the vehicle.

The rights and obligations of the parties shall be governed by the vehicle rental agreement, these GTC, the document "Rental Terms and Fees", as well as the provisions of Act No. 513/1991 Coll., the Commercial Code, as amended from time to time.

Terms of the lease and obligations of the parties

1. Handover and return of the vehicle:

The handover and return of the vehicle is recorded in a mutually signed vehicle handover and return report. The lessor is obliged to hand over the vehicle in a condition suitable for normal use, without obvious defects and faults, with the necessary documents and mandatory equipment. The Lessee is obliged to return the vehicle in a condition corresponding to normal wear and tear, including documents and accessories.

Normal wear and tear does not include defects caused by improper use, lack of maintenance, traffic accidents or accidents. If the vehicle is returned in an excessively dirty condition, the Lessor shall be entitled to charge a cleaning fee in accordance with the "Fees and Penalties" document.

2. Use of the vehicle:

The Lessee agrees not to use the vehicle for:

- transport in violation of laws (e.g. customs regulations),

- commercial purposes without the consent of the Lessor,

- car races and events,

- driving under the influence of alcohol or drugs,

- outside the country of rental without the written consent of the Lessor.

The Lessee may not make any modifications to the vehicle without the written consent of the Lessor.

3. Insurance and risk coverage:

The Lessor provides compulsory insurance and accident insurance of vehicles, while the Lessee is obliged to pay the deductible in the event of an insurance claim. The deductible and the conditions of coverage are defined in the rental agreement. The insurance does not cover damage caused by alcohol, drugs or negligent use of the vehicle.

Flexible cancellation policy

For cancellations, the following cancellation fees apply depending on the time remaining until the scheduled start of the rental:

-More than 3 months before the start of the rental period: 0% of the total rental amount (no cancellation fee).

-3 - 2 months before the start of the rental period: 10% of the total rental amount.

-2 - 1 month before the start of the rental period: 30% of the total rental amount.

-30 - 20 days before the start of the rental period: 50% of the total rental amount.

-19 - 8 days before the start of the rental period: 70% of the total rental amount.

-7 - 0 days before the start of the rental period: 100% of the total rental amount (full rental price).

The customer has the possibility to request a change of the reservation date or the type of vehicle, provided that this change is notified well in advance and the Lessor has available capacity. If the change is not possible, the above cancellation charges will apply.

Cross-border rental

Use of the vehicle outside the rental country is only possible with the written consent of the Lessor. The Lessee is obliged to provide all necessary documents (e.g. green card) at his/her own expense.

Digital technologies

- Vehicles may be equipped with GPS position monitoring devices for the purpose of vehicle safety and security.

- Deposits and payments are processed electronically, with the Lessee receiving confirmation of each transaction.

Assistance services

The landlord provides 24-hour assistance services. In the event of a breakdown, accident or theft of the vehicle, the Lessee may contact the emergency line at the number specified in the rental agreement.

Additional services

- Chauffeur-driven rental: this service is available on request at an additional cost.

- Rental of accessories: child seats, GPS navigation and other accessories are available according to the current offer.

Payment terms

-Short-term rental (up to 30 days): payment based on invoice with a due date of 2 days.

-Long-term rentals (over 30 days): invoiced monthly with a due date of 5 days.

Rent is always paid in advance.

Contractual fines and penalties

The Lessor is entitled to charge a contractual penalty of EUR 200 for each individual violation for breach of the obligations set out in these GTC, unless otherwise specified in the document "Fees and Penalties".

Final provisions

These General Terms and Conditions come into force on 1.4.2021. Any changes or additions must be made in writing and approved by both parties.
